Welcome to Klutch Sports. By accessing and using our platform, booking sports venues, or utilizing any of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.

These terms constitute a legally binding agreement between you (the user) and Klutch Sports. If you do not agree with any part of these terms, you must not use our platform or services.

Your use of our services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our platform, you also consent to our data collection and usage practices as outlined in the Privacy Policy.

2. Booking & Payments

All bookings made through our platform are subject to availability and confirmation. Here are the key terms regarding bookings and payments:

Booking Confirmation

• Advance Payment Required: All bookings must be confirmed with full advance payment at the time of reservation
• Confirmation Email: You will receive a booking confirmation email after successful payment processing
• Booking Reference: Each booking is assigned a unique reference number for tracking and management
• Availability: Bookings are subject to real-time venue availability and may be declined if slots are no longer available

Pricing & Fees

• Dynamic Pricing: Prices displayed on our platform are subject to change based on demand, time of day, and special events
• Price Lock: Once you complete your booking and payment, the price is locked and will not change
• Payment Methods: We accept various payment methods including credit cards, debit cards, and digital wallets
• Processing Fees: Payment processing fees, if applicable, will be clearly displayed before checkout
• Tax Inclusion: All prices include applicable taxes unless otherwise stated

Payment Security

• All payments are processed through secure, PCI-compliant payment gateways
• We do not store complete credit card information on our servers
• All transactions are encrypted and protected

3. Cancellation & Refund Policy

We understand that plans can change. Here are our policies regarding cancellations and refunds:

Cancellation Window

• 24+ Hours Notice: Full refund if cancelled at least 24 hours before the booking time
• 12-24 Hours Notice: 50% refund if cancelled between 12 to 24 hours before booking time
• Less than 12 Hours: No refund for cancellations made less than 12 hours before booking time
• No-Show: No refund will be issued for no-shows or late arrivals

Refund Processing

• Eligible refunds will be processed within 5-7 business days
• Refunds will be credited to the original payment method used for booking
• Payment gateway fees may not be refundable

Rescheduling

• Free Rescheduling: You may reschedule your booking at no additional charge if done at least 24 hours in advance
• Subject to Availability: Rescheduling is subject to venue availability for the requested new time slot
• Price Difference: If the new booking time has a different price, you may need to pay the difference or receive a credit
• One-Time Change: Free rescheduling is limited to one change per booking

4. User Responsibilities

As a user of our platform and facilities, you agree to the following responsibilities:

Venue Respect & Care

• Property Respect: Treat all venue property, equipment, and facilities with care and respect
• Cleanliness: Maintain cleanliness and dispose of waste in designated areas
• Equipment Use: Use sports equipment only for its intended purpose
• Facility Rules: Follow all posted rules and regulations at each venue

Conduct & Behavior

• Respectful Behavior: Treat other players, staff, and venue personnel with courtesy and respect
• No Misconduct: Aggressive behavior, fighting, or verbal abuse will not be tolerated
• No Illegal Activities: Illegal activities including but not limited to gambling, substance abuse, or theft are strictly prohibited
• Fair Play: Maintain the spirit of sportsmanship and fair play at all times

Safety Requirements

• Proper Footwear: Wear appropriate sports footwear for the activity. Street shoes, hard-soled shoes, or inappropriate footwear may damage courts and are not permitted
• Safety Gear: Use recommended safety equipment for your chosen sport
• Physical Fitness: Ensure you are physically fit to participate in sports activities
• Medical Conditions: Inform staff of any medical conditions that may affect your participation

Booking Accuracy

• Provide accurate contact information for booking confirmations and updates
• Arrive on time for your booking slot
• Notify us promptly of any changes to your booking requirements
• Ensure you book the correct sport, venue, and time slot

5. Damage & Liability

Understanding liability and responsibilities is crucial for a safe sports environment:

User Liability for Damages

• Damage Responsibility: Users are fully responsible for any damages caused to venue property, equipment, or facilities during their booking period
• Repair Costs: You will be charged for the repair or replacement costs of any damaged property
• Assessment: Venue management will assess damages and provide an itemized invoice
• Payment Required: Damage costs must be paid before future bookings can be made

Personal Injury & Assumption of Risk

• Voluntary Participation: You acknowledge that participation in sports activities involves inherent risks
• Assumption of Risk: You voluntarily assume all risks associated with sports participation, including but not limited to injuries, accidents, and physical harm
• No Liability: Klutch Sports, venue owners, and their staff are not liable for any injuries, accidents, or health issues arising from your participation in sports activities
• Medical Expenses: You are responsible for all medical expenses resulting from injuries sustained during sports activities

Limitation of Liability

• We do not accept liability for loss or damage to personal belongings
• Venue lockers and storage are used at your own risk
• We are not responsible for interactions or disputes between users
• Our total liability is limited to the amount paid for your booking

6. Weather & Force Majeure

Outdoor sports are subject to weather conditions and unforeseen circumstances:

Weather-Related Cancellations

• Extreme Weather: In case of extreme weather conditions (heavy rain, storms, extreme heat), bookings may be cancelled or rescheduled for safety reasons
• Venue Decision: Venue management has the final authority to cancel bookings due to weather or unsafe conditions
• Notification: We will notify you as soon as possible if your booking is affected by weather
• Rescheduling: Weather-related cancellations can be rescheduled at no additional charge or refunded in full

Force Majeure Events

• Uncontrollable Events: We are not liable for failures or delays caused by circumstances beyond our reasonable control
• Examples: Natural disasters, pandemics, government restrictions, power outages, technical failures, or civil unrest
• Refund/Credit: In case of force majeure events, we will provide refunds or booking credits as appropriate
• No Damages: Neither party shall be liable for damages resulting from force majeure events

7. Code of Conduct

To ensure a positive experience for all users, we maintain a strict code of conduct:

Expected Behavior

• Respect Others: Treat all players, staff, and guests with respect and courtesy
• Inclusive Environment: Support an inclusive and welcoming environment for all users regardless of skill level, background, or identity
• Fair Competition: Engage in fair and honest competition
• Follow Instructions: Comply with instructions from venue staff and management

Prohibited Behavior

• Abusive Conduct: Verbal abuse, harassment, intimidation, or threatening behavior
• Physical Altercations: Any form of violence or physical confrontation
• Discrimination: Discriminatory behavior based on race, gender, religion, or any other protected characteristic
• Disruptive Actions: Behavior that disrupts other users' enjoyment of facilities
• Substance Abuse: Use of alcohol, drugs, or intoxicating substances on premises

Enforcement & Consequences

• Right to Remove: Venue management reserves the right to remove any user violating the code of conduct
• No Refund: Removal due to misconduct will result in forfeiture of booking fees without refund
• Account Suspension: Serious or repeated violations may result in temporary or permanent account suspension
• Legal Action: Severe violations may result in legal action and prosecution

8. Intellectual Property

All content on our platform is protected by intellectual property rights:

Ownership

• Platform Content: All website content, including text, graphics, logos, images, videos, and software, belongs to Klutch Sports or our licensors
• Branding: Our name, logo, and trademarks are protected intellectual property
• Copyright: All materials are protected under copyright laws
• Design Elements: Website design, layout, and user interface are proprietary

Usage Restrictions

• No Reproduction: You may not reproduce, duplicate, copy, or resell any part of our platform without explicit written permission
• No Commercial Use: Content may not be used for commercial purposes without authorization
